1. Agreement to Terms

By accessing or using loavesand.fish ("https://loavesand.fish"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service.

loavesand.fish is operated under the funding and guidance of kingdominvest.ing.

2. Service Description

loavesand.fish is a real-time food rescue platform that connects:

• Food Donors: Restaurants, grocery stores, event venues, and individuals with surplus food
• Food Recipients: Shelters, food banks, soup kitchens, churches, and families in need
• Volunteer Drivers: Individuals who transport food from donors to recipients

We facilitate connections but do not directly handle, prepare, or transport food. All food donations are made directly between donors and recipients.

3. Good Samaritan Food Donation Act

All users must still adhere to food safety guidelines and local health regulations. See our Food Safety Guidelines for more information.

4. User Accounts

4.1 Account Creation

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Promptly update any changes to your information
• Accept responsibility for all activity under your account

4.2 Account Types

• Donors: Must provide accurate business/organization information and food safety certifications where applicable
• Recipients: Must provide verification of nonprofit status (501(c)(3)) or equivalent, or demonstrate genuine need
• Drivers: Must consent to background checks and provide accurate vehicle information

4.3 Age Requirement

You must be at least 13 years old to create an account. Users under 18 require parental consent. Volunteer drivers must be at least 18 years old with a valid driver's license.

5. Acceptable Use

You agree NOT to:

• Donate food that is unsafe, expired, or contaminated
• Misrepresent food quality, quantity, or dietary information
• Use the platform for commercial gain or resale of donated food
• Harass, threaten, or discriminate against other users
• Provide false information about your organization or needs
• Attempt to circumvent platform fees or abuse donation receipts
• Violate any local, state, or federal laws
• Use automated systems to access the platform without permission

6. Food Safety Requirements

All food donations must:

• Be "apparently wholesome" at the time of donation
• Meet applicable temperature requirements (hot food above 140°F, cold food below 40°F)
• Be accurately described including allergens and dietary restrictions
• Be packaged appropriately for safe transport
• Not be past their expiration date (best-by dates are acceptable)

Donors are responsible for ensuring food meets safety standards at the time of donation. Recipients are responsible for proper handling after receipt.

7. Donations and Payments

7.1 Financial Donations

loavesand.fish accepts financial donations to support platform operations. All payments are processed by Stripe. Donations are in US Dollars (USD).

7.2 Tax Receipts

We generate donation receipts for food donors to assist with tax deductions. However, we are not tax advisors. Consult a tax professional regarding deductibility.

7.3 Refunds

Financial donations are generally non-refundable. Contact us within 7 days of a mistaken donation for consideration.

8. Intellectual Property

The loavesand.fish name, logo, and platform design are our intellectual property. User-submitted content (photos, descriptions) remains yours, but you grant us a license to display it on the platform.

9. Disclaimer of Warranties

loavesand.fish is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. We do not warrant that:

• The service will be uninterrupted or error-free
• Food donations will meet your specific needs
• All user-provided information is accurate
• The platform will be available in your area

10. Limitation of Liability

To the maximum extent permitted by law, loavesand.fish, its operators, and affiliates shall not be liable for:

• Any indirect, incidental, special, or consequential damages
• Food-related illness or injury (see Good Samaritan Act protections)
• Actions of third-party users (donors, recipients, drivers)
• Loss of data or service interruptions

Our total liability shall not exceed the amount you have paid us in the past 12 months, or $100, whichever is greater.

11. Indemnification

You agree to indemnify and hold harmless loavesand.fish and its operators from any claims, damages, or expenses arising from your use of the platform or violation of these terms.

12. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason with notice. You may delete your account at any time through your account settings.

Upon termination, your right to use the service ceases immediately. Provisions that should survive termination (liability, indemnification) will remain in effect.

13. Changes to Terms

We may modify these terms at any time. Material changes will be communicated via email or prominent notice on the platform. Continued use after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the United States and the State of Texas, without regard to conflict of law principles.
